Good Talk App and Website Terms of Use

Welcome to Good Talk. These Good Talk App and Website Terms of Use ("Terms") govern your access to and use of the Good Talk app and website for individual, non-school use. By accessing or using the Good Talk app or website, you agree to these Terms.

These Terms do not govern use of Good Talk under a Good Talk EDU contract. When Good Talk is used under a Good Talk EDU contract with a school, district, or education institution, the Good Talk EDU Terms of Use, the Good Talk EDU Privacy Policy, and that contract apply.

1. Acceptance and Privacy Policy

By using the Good Talk app or website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and the Good Talk App and Website Privacy Policy.

2. Description of Good Talk

Good Talk offers AI-powered conversation simulations, coaching, feedback, scoring, scenario generation, text and voice practice, safety checks, and related tools. All conversations in Good Talk are simulations with AI technology. They are not conversations with a human, therapist, counselor, attorney, doctor, crisis responder, or other professional.

• Good Talk is designed for practice, reflection, learning, and communication skill building.
• Real-life interactions may vary significantly from how conversations turn out in Good Talk.
• Good Talk is not responsible for the outcome of any real-life conversation or situation based on simulations, coaching, feedback, or suggestions provided by Good Talk.
• Coaching received in Good Talk is not a substitute for professional advice, therapy, medical care, legal advice, crisis support, or educator judgment.
• While Good Talk attempts to identify and block objectionable or unsafe content, we do not guarantee that every issue will be identified, blocked, or handled correctly.

3. App Accounts and Access

• The Good Talk app may be used without signing in where anonymous use is available.
• The Good Talk app may create a random device or app identifier so Good Talk can maintain app state, conversation history, scores, and usage limits.
• Optional sign-in may be available so users can connect app activity to an account.
• If you sign in to the Good Talk app, you must provide accurate account information through the applicable identity provider.
• If history migration is offered, you may choose whether to move anonymous device-local history into the signed-in account or start fresh.
• You must not share login credentials, bypass access controls, use another person's account, or attempt to access another user's data.

4. Student Use

• Students should use Good Talk through Good Talk EDU when their school provides Good Talk under a Good Talk EDU contract.
• If you are using Good Talk under a Good Talk EDU contract with a school, district, or education institution, see the Good Talk EDU Terms of Use.

5. User Content and Conduct

You are responsible for the information you submit to Good Talk. You agree to use Good Talk only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Good Talk app or website.

• Do not include names, contact information, or other personal information about real people in shared scenarios.
• Do not submit personal information about another person unless you have permission to do so.
• Do not use Good Talk to create, request, transmit, or promote violence, hate speech, weapons use, explicit sexual content, self-harm instructions or encouragement, harassment, abuse, exploitation, or criminal activity.
• Do not attempt to bypass safety systems, content filters, security controls, usage limits, or access restrictions.
• Do not disrupt, overload, scrape, reverse engineer, probe, or interfere with the normal operation of Good Talk.

6. AI Processing and Safety

Good Talk uses AI service providers to generate simulated responses, coaching, scoring, scenario metadata, safety checks, voice responses, and transcriptions. AI output may be inaccurate, incomplete, inappropriate, or unsuitable for your situation. You should use your own judgment before applying any suggestion outside the app.

If Good Talk identifies content that may violate these Terms or safety rules, the app may block the content, exclude it from the simulation, show a safety message, provide a support resource, limit functionality, or take other action we consider appropriate.

7. Intellectual Property

All content included on Good Talk, such as text, graphics, logos, button icons, images, audio clips, digital downloads, software, and service design, is the property of Good Talk or its content suppliers and protected by copyright, trademark, and other laws. You may use Good Talk only as permitted by these Terms and the app experience.

8. Disclaimer of Warranties and Liability

Good Talk provides the Good Talk app and website on an "as is" and "as available" basis without any representations or warranties of any kind, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You expressly agree that your use of the Good Talk app and website is at your sole risk.

Good Talk, its affiliates, and their respective employees, agents, third-party content providers, and licensors do not warrant that the Good Talk app or website will be uninterrupted or error-free, that all content will be accurate or appropriate, or that the results obtained from use of the Good Talk app or website will meet your needs.

9. Limitation of Liability

To the maximum extent permitted by law, Good Talk will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from use of, or inability to use, the Good Talk app or website.

10. Changes to These Terms

Good Talk reserves the right, at its sole discretion, to modify or replace these Terms at any time. If the changes constitute a material change, Good Talk will provide notice by posting an announcement in the app, updating this page, or using another reasonable notice method.
